The Law Firm of Flora Templeton Stuart represents clients with financial needs who must file Chapter 7 bankruptcy. Our Law Firm takes pride in accepting a payment plan in all bankruptcy matters.

The filing of bankruptcy will immediately stop garnishment of wages and creditor harassment. We believe in the rights of debtors and will work hard to protect those rights.

How do I file?

You will need to bring with you: most recent check stub(s), a complete list of your bills, any lawsuits or civil summons you have received, and the attorney fee payment. You are required to complete credit counseling through an agency approved by the bankruptcy court before you file for bankruptcy. Additionally, we will analyze your income to determine if you are eligible to file.

At the second interview:

We will collect data to complete the bankruptcy petition and collect the following required documents:

  1. All check stubs from EMPLOYMENT for the past SIX months, or a print out from your employer showing Gross, Deductions and Net Pay.
  2. Bank statements for all bank accounts for the SIX months preceding the filing of bankruptcy. You will also need the one for the month in which you file and should make sure to put that in a safe place upon its receipt. (If lost- these may be obtained from your bank).
  3. Copies of your last filed tax returns. To obtain a free copy call 1-800-829-1040. When calling ask for a FREE TRANSCRIPT. You should receive your transcript in approximately 10 days. You will need tax returns for prior two years or W-2 forms if taxes were not filed last year; but still provide last tax return filed.
  4. Copies of all titles to all, vehicles, motor homes, trailers or boats. (If lost - these may be obtained from the office of the county court clerk in which the vehicle is registered).
  5. 401K/retirement balances You must obtain an accurate balance of your retirement fund.
  6. 401k/retirement loans - You must list any retirement loans on your creditor list as an unsecured debt just like any other debt you owe. You will be allowed to keep the loan and continue repayment, but the loan(s) must be properly listed including address and zip code of the investment provider.
  7. Certificates of stock, bonds & keys to any safe deposit boxes.
  8. Contracts of life or burial insurance.
  9. The Creditor Packet we send you must be completed.

HOME OWNERS MUST PROVIDE:

  1. Recorded copies of all deeds and contracts under which you hold title to, or an interest in real estate along with a copy of all liens, mortgages, or encumbrances. (If lost - these may be obtained from the office of the county court clerk of the county in which the real estate is located.
  2. Recorded Copy of Mortgage(s) on Property and Last Mortgage Statement showing the actual balance on the loan.
  3. Statement from Tax Assessor (PVA) as to the "assessed" value of the property.

You will also need to bring your second attorney fee payment.

At the third appointment:

Your bankruptcy petition will be filed and you will receive you bankruptcy court date. You will also need to bring your third attorney fee payment. At this point, wage garnishments will be stopped. Within 45 days of filing, debtor(s) must complete a debt management class.

Last:

You will attend your bankruptcy hearing. Your final payment is due at this time, and you will be discharged in about 2 months.
