Who is Eligible for Disability Benefits?
|
Any disabled adult under the age of 65 is eligible for Disability Insurance Benefits, provided they have worked 5
of the last 10 years. Children of disabled adults (who are drawing Disability Insurance Benefits), who prove to
be disabled are eligible to draw Disability Insurance Benefits under their parent's record. Disabled widows or
widowers between the ages of 50 and 60 may be eligible to draw benefits from their deceased spouse's Social
Security record, if the spouse was eligible to draw Disability Insurance Benefits.
Any disabled person (including children) under the age of 65 who has not worked 5 of the last 10 years can
be eligible.
If you are eligible and receive Disability Insurance Benefits, then after you have been receiving these benefits
for 24 months, you are eligible to receive a Medicare card, for a nominal amount, which will be withheld from your
monthly benefits. If you are eligible and receive Supplemental Security Income you are eligible to receive a
Medicaid card immediately after being approved for benefits.for Supplemental Security Income, provided they are
income and resource eligible.

How Do I Apply for Disability?
|
|
If you have not yet applied for disability, our law firm will be glad to assist you. At your first conference with
our office, we will contact the Social Security Administration for you to set up your application. We will assist
you in completing the forms so you can apply for disability. This includes the application itself, which requests
information about your work history, condition of disability (physical and/or mental), treatment history, medications,
educational background, and other information as requested by the Social Security Administration. Sometimes it is
difficult for our clients to handle this by themselves, and this is why we are here to help begin your case.

How Can I Get Medical Documentation If I Cannot Afford a Physician?

Appeal Levels

RECONSIDERATION - You may request a review of your case if you disagree with the first decision.
You have 60 days from the date of your denial to file this appeal. If we are your representative, we will file all
of the necessary paperwork to appeal this decision.
HEARING - You may request a hearing before a judge if you disagree with the reconsideration decision.
Again, you have 60 days from the date of the denial of reconsideration to appeal. If we represent you, we will file all
necessary paperwork to make this appeal.
APPEALS COUNCIL REVIEW - You may request Appeals Council to review your case if you disagree with the
Administrative Law Judge's decision. If we represent you, we will be glad to file this appeal for you, within 60 days
of the unfavorable hearing decision.
FEDERAL COURT - You may request an appeal through the United States Court system, starting with the
United States District Court, if you disagree with the Appeals Council's decision or denial of your request for review.

Remember, if you disagree with any decision, you have 60 days to appeal to the nest level until you are satisfied with
the decision or have won your claim. You have many other rights our law firm will review with you during our representation.

How Long Will It Take?

How Long Must I wait to Have My Social Security Hearing with a Judge?
It usually takes up to 12 months to obtain a favorable ruling in a Social Security claim and will usually be 12 months
before you have a hearing with Social Security Administrative Law Judge. It could take a longer or shorter period of
time, depending on your individual case. We cannot guarantee that you will be successful in your Social Security claim,
but we can guarantee that we will do everything that we can to speed up the process and win your claim.
